Frequently Asked Questions on Affordable Ownership Programs

1. Can I put my name on a waiting list?

No, the City of Tustin does not maintain a waiting list.

a. New Units – The developer is responsible for selling the affordable units.
b. Resale Units – The current owner is responsible for selling their affordable unit. For a list of available resale units, click here.

2. How much down payment is required to purchase an affordable unit?

The City of Tustin requires that applicants put down a minimum of 3% as a down payment. The 3% down payment must be the buyers' own funds.

3. Does the 3% down payment also cover my closing costs?

No, it does not. The 3% down payment does not include any applicable closing costs.

4. Am I allowed to use funds that were given to me for a down payment?

Yes, gift funds are acceptable for additional down payment in excess of the minimum 3% down payment. A gift letter must be submitted along with supporting documentation reflecting funds available.

5. Do I have the choice of selling my unit once I have purchased it?

Yes, you do have the ability to sell your unit.  The unit must be sold to a qualified affordable household at a price that falls within the affordable criteria of that unit.

6. Who and how is the sales price of an affordable unit determined?

The Affordable Sales Price is calculated by the City. The price is established using current income limits established by the State of California Department of Housing and Community development (HCD) and the current housing costs e.g. homeowner association dues, property taxes, insurance, and utility allowance. The current interest rate is also used in determining the affordable sales price.

7. Can I refinance my mortgage in the future?

Yes, the homeowner is allowed the opportunity to refinance their home as long as the new loan does not exceed 97% of the current affordable sales price and the new housing payment does not exceed affordable guidelines.  Please contact the City prior to initiating the refinancing process. 8. Can I use my own lender?

Yes, you may use a lender of your choice.  However, for your convenience, the City does maintain a list of lenders that are familiar with the City’s affordable housing programs. For a list of lenders, click here.
